General Terms and Conditions of GLOBAL Moving and Shipping BV

  1. General

These general terms and conditions apply to all services provided by GLOBAL Moving and Shipping BV, hereinafter referred to as “GMS”, regarding international and domestic removals, transport, storage, and related services. All agreements entered into are subject to these terms and conditions, unless otherwise agreed in writing.


  1. Reference to the Dutch Forwarding Conditions (Fenex Conditions)

All services provided by GMS are performed in accordance with the Dutch Forwarding Conditions of Fenex, as applicable at the time of service. These conditions can be found on the Fenex website (www.fenex.nl). In the event of any conflict between the Fenex conditions and these general terms, the provisions of these general terms and conditions will take precedence, unless otherwise stated.


  1. Liability

GMS is only liable for damage directly resulting from gross negligence or willful misconduct. In all other cases, GMS is not liable for any damage, costs, or losses arising from the performance of the agreement, including but not limited to damage to goods, loss of goods, delays in transport, or other incidents occurring during the relocation or transport.

All risks related to the goods, including damage, loss, theft, or delay, are the responsibility of the customer. The customer is responsible for adequately insuring the goods against all risks that may occur during the relocation or transport. GLOBAL Moving and Shipping BV strongly advises the customer to obtain comprehensive insurance for the relocation.


  1. Rates and Payments

All rates presented by the mover are based on current market conditions, prices, exchange rates, and the availability of services. GLOBAL Moving and Shipping BV reserves the right to revise or adjust rates in the event of changes in transport costs, fuel prices, customs duties, exchange rates, or other unforeseen circumstances that may affect the final cost of the move.

Rates are subject to the factors mentioned above and may be adjusted at any time without prior notice, depending on changes in these circumstances. It is therefore difficult to guarantee the long-term validity of the rates, especially given the dynamics of the international transport and moving industry.


  1. Changes and Cancellations

In the event of changes or cancellations by the customer, additional charges may apply, depending on the time frame and costs already incurred by GMS. The customer must submit changes or cancellations in writing, and GMS will attempt to provide a suitable solution. All costs arising from changes or cancellations are the responsibility of the customer.


  1. Force Majeure

GLOBAL Moving and Shipping BV is not liable for any delays, damage, or losses arising from force majeure, including but not limited to natural disasters, political unrest, war, strikes, technical failures, adverse weather conditions, customs delays, or other unforeseen circumstances beyond the control of GMS.


  1. Customer Responsibilities

The customer is responsible for providing all necessary documents and information required for transport and relocation, such as import and export permits, customs documentation, and address details. The customer must ensure that all goods are properly packed and suitable for transport. Any costs arising from incorrect or incomplete information are the responsibility of the customer.


  1. Payment

Payment for GMS services must be made according to the agreed payment terms, and in most cases, prior to the commencement of the relocation or transport, unless otherwise agreed. If the customer fails to make the payment on time, GLOBAL Moving and Shipping BV reserves the right to suspend or terminate the service. Any costs arising from non-payment, including collection fees and interest, are the responsibility of the customer.


  1. Governing Law and Disputes

All agreements between the customer and GLOBAL Moving and Shipping BV are governed by Dutch law. In the event of a dispute, the competent court in the Netherlands will have exclusive jurisdiction, unless otherwise agreed.


  1. Final Provisions

If any provision of these general terms and conditions is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect. GMS may amend these general terms and conditions at any time. Any changes will take effect as soon as they are published on the GMS website.
